Update: Court records show that prosecutors decided not to file charge against Nelson Dario Yanez. The case was formally dismissed on July 20, records show.
Original story: A 46-year-old Wellington man is accused of unlicensed contracting and defrauding an older man of $2,000.
Palm Beach County Sheriff’s Office deputies arrested Nelson Dario Yanez on Tuesday after an 85-year-old suburban Boynton Beach man alleged that Yanez failed to complete renovations at his home. The man also alleged that Yanez refused to return a $2,000 deposit check.
Yanez was released from the Palm Beach County Jail on Wednesday on $2,000 bail. His arrest stems from an investigation that was started by Palm Beach County’s Planning, Zoning and Building Department and turned over to the sheriff’s office June 1.
The alleged victim told investigators that in February he entered into an agreement to have Yanez do work that included renovations to a bathroom and ceiling repairs. The man said he discussed downsizing the scope of the repairs and Yanez agreed to wait for a smaller deposit.
However, he later learned Yanez had already cashed the $2,000 check, according to a sheriff’s arrest report. The man said that Yanez refused to take his calls during the following weeks and did not reply to a certified letter.
On Tuesday, deputies made contact with Yanez, who admitted to writing a work contract without having a license, deputies said. Yanez also said that he did cash the $2,000 check, according to a sheriff’s arrest report.
However, Yanez claimed that the client did not try to contact him and said he believed the man wanted to defer the project, the arrest report said.
